Hi all,
just got back from south Africa,
I Took a call from my accident management lot that are looking after me, they have valued your car at 1750, damage they say is 3500, so you can keep the car less 2oo quid, I said your repairing it, Owe, she said we did not know, does the garage know this yes I said ahh ok, we wil ring then back and tell the other insurance company, I said will you be paying me for the bits, Rolls off a lot of costs bla bal, will you pay me to remove everything and stick on replacement car, I want a forced repair no cat D nothing, and your damage quote is a joke, it was twice as bad as that last time and it was around 1250 quid..
Your thoughts guys...
ps they sent a letter to the garage, once you have been in contact with Mr Hayward you can scrap it... ha ha, my garage man told them the same as me, its repairable, go away and rethink your figures, either way I get the car back,I have it in writing the car is still mine bla bla bla

pps I said if you take any longer I will just get it repaired and bill you!!, I know have to wait another three days..

they cannot write off a car thats not theirs to write off

its that simple . get the body shop to give you a qoute and send it to them and then say its this to fix it .

if not i want 3 k for the car and the hassel of being off the road .

and you keep the car as that way theires no cat c or what ever that comes into play . nothing is logged against the car . they are basically paying you a cash settlement to go awa

Martin's right. It's not your insurer so they have no right to cat d it. You are the aggrieved party claiming against their insured party, they must repair it if you say so. If you were claiming on your own insurance, it would be a whole different ball game.

And their valuation of the car has nothing whatsoever to do with it. It's not worth the paper it's written on.

Update, I have spoke to my legal team and they do not know the answer, she is in court now and will ask, I can quote from the Engineers report,value 1,750 pounds!!!, damage repair 3151 pounds, we recommend the vehicle is treated as a Cat C, and can be repaired,and can be resold as repairable salvage..

Sorry I can't advise you H as fortunately I haven't had many dealings with insurance companies,not for serious stuff like this anyway.Just wanted to say I'm really sorry to hear you and your coupe are going through the mill again.I know you will get it back on the road again but what a pain!!!

Insurance companies are a law unto themselves.

Because your claim wont fit their model you are in for a rough ride.

I think they have under valued your car which is a negotiating point. Find adverts for like for like cars, insurance valuations of similar cars also does the club have a valuation person who could draft a supporting letter for you?

A few years ago I wrote off am Audi A4 2.6 V6 Quattro, the insurer did a cursory valuation based on cars of the same year. I think it was around £1800 average but when I checked there was only 4 of the same model and engine for sale in the whole of the UK the average was £3500. I had a word to the assessor and you would have thought it was coming out his own pocket but he did eventually concede.

Tell them to find you a replacement car see how they get on.

Keep at them.

Well no news, I rang the people who were dealing with my case and told them they are rubbish, there assessor is a joke, how can you estimate the damage if you do not strip the car down, and have a proper look, B you undervalued my car and C as above get me a coupe the same as mine, one of 200 odd that were sold with extras etc and, don't forget all my mods etc,don't talk to me about rust spots, show me a 20 year old car that has not got any, Cannot get panels**, I have got all the panels, I have bought them all, shot hem down in flames basically, 3150 pounds worth of damage my car,but you valued it as 1800, all you want to do is scrap my car and move on to the next customer, no thanks, right come and collect your car, I am dealing with the guy who hit me... they did not like it one bit,now waiting for one car to go and another to arrive lol.

pps at the end of the day what ever happens it will be repaired.... even if I have to sue to get my costs back..

Its a clear cut case . as i said his insurerr will prefer to deal with you as they avoid the other partys costs .


All you have to say is i want 2500 cash settlement or ill see you in court. Its thst simple. Small claims court is 125 pound and any solitor will take ur case on with a no win no fee deal no problems at all .

When I tried to took to the other party's insurances company after the guy hit my van they say they could only speak with my insurance company not me!

You would think I speak a different langue to them and they have no interpreter.
